Please read these terms and conditions carefully before using Our Service.

Welcome to Pickup! These Terms of Service ("Terms") govern your access to and use of our mobile application and services (collectively, Pickup). By accessing or using Pickup, you agree to be bound by these Terms. If you do not agree, you may not access or use Pickup.

1. Acceptance of Terms

By accessing or using Pickup, you confirm that you are at least 18 years of age or have obtained the consent of a legal guardian. Your use of Pickup constitutes your agreement to comply with these Terms and any applicable laws and regulations. Additional terms may apply to certain features, which will be disclosed when applicable.

2. Account Registration and Security

a. Account Creation

To access certain features of Pickup, you may be required to register for an account. You must provide accurate, current, and complete information during the registration process and keep your account information updated.

b. Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. Notify us immediately of any unauthorized access or suspected security breaches.

c. Eligibility

By creating an account, you represent and warrant that you meet the eligibility requirements set forth in these Terms. We reserve the right to refuse access to Pickup to any user at our sole discretion.

3. User Responsibilities

a. General Conduct

  • You agree to use Pickup in a manner that complies with all applicable laws, regulations, and these Terms.
  • You will not use Pickup to upload, share, or distribute content that is illegal, harmful, or otherwise objectionable.

b. Interactions with Other Users

Your interactions with other users, both on and off Pickup, are your sole responsibility. While we provide a platform for connecting users, we are not involved in or responsible for any offline activities, disputes, or outcomes.

c. Respectful Behavior

You must treat all users with respect. Harassment, discrimination, or abusive behavior will not be tolerated and may result in the suspension or termination of your account.

4. Payment and Escrow

  • All payments are processed via Stripe and held in escrow until the game is completed.
  • Payments must be made in Hong Kong Dollars (HKD). Additional payment options, such as Alipay and WeChat Pay, are supported through Stripe.
  • After the game concludes, funds (minus platform fees) are released to the host.

5. Cancellation and Refund Policies

Host-Initiated Cancellations

  • Hosts who cancel a game are subject to a fine proportional to the number of participants registered. The fine is calculated as follows: Fine = Base Fee × Number of Participants × Multiplier.
  • Multiplier values: 1.0 (48+ hours notice), 1.5 (24-48 hours notice), and 2.0 (less than 24 hours notice).
  • Minimum fine: $20 HKD; Maximum fine: $500 HKD. Fines are deducted from the host's account or escrow funds to cover participant refunds.

User-Initiated Cancellations

  • 100% refund if cancelled 48+ hours before the game.
  • 50% refund if cancelled 24-48 hours before the game.
  • No refund if cancelled within 24 hours of the game.
  • Platform service fees are non-refundable.

Platform-Initiated Cancellations

In the event of a platform-initiated cancellation (e.g., technical errors, fraud prevention), all participants will receive a full refund.

6. Refund Processing

Refunds are processed automatically based on the applicable cancellation policy. Refunds may take up to 7-10 business days to reflect in the user's account, depending on the payment method used.

7. Dispute Resolution

  • Users and hosts may raise disputes regarding cancellations or other issues via the platform's support system.
  • We reserve the right to review evidence provided by both parties and make a final determination, which may include additional refunds, fines, or penalties.
  • All decisions made by the platform regarding disputes are final and binding.

8. Platform Fees

  • We charge a service fee for facilitating games and processing payments. This fee is transparently disclosed during payment and deducted from the host's payout.
  • Platform fees are non-refundable under any circumstances.

9. Hosting and Participation in Games

a. Hosting Responsibilities

  • As a host, you must provide accurate and complete details about your game, including time, location, and any requirements.
  • If the participation requirements are met, you are obligated to honor your commitment to host the game.
  • Hosts are responsible for ensuring the safety and suitability of the game venue.

b. Joining Responsibilities

By joining a game, you agree to participate as committed. Repeated no-shows or cancellations without notice may result in limitations on your ability to join future games.

c. Cancellations

If you are unable to host or attend a game, you must notify participants promptly through Pickup. Consistent cancellations may affect your account standing.

d. Code of Conduct During Games

Participants must adhere to the rules of the game and treat all other players with respect. Disruptive or unsafe behavior may result in removal from the game and potential account suspension.

10. Limitations of Liability and Disclaimers

a. Liability for Off-App Activities

Pickup facilitates connections between users but does not oversee or manage interactions outside of Pickup. We are not responsible for any injuries, disputes, damages, or other incidents that occur during or as a result of events organized through Pickup.

b. Disclaimer of Warranties

Pickup is provided "as is" and "as available," without any warranties, express or implied. We do not guarantee the accuracy, reliability, or availability of Pickup or its content.

c. Limitation of Liability

To the maximum extent permitted by law, Pickup and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

11. Prohibited Activities

  • Use Pickup for any illegal, fraudulent, or unauthorized purpose.
  • Impersonate any individual or entity.
  • Interfere with or disrupt the operation of Pickup.
  • Harass, threaten, or harm other users.
  • Share false or misleading information.

12. Intellectual Property

All content, features, and functionality of Pickup are the exclusive property of Pickup or its licensors. Unauthorized use, reproduction, or distribution is strictly prohibited.

13. Third-Party Services

Pickup may include links to third-party websites or services. We do not endorse or assume any responsibility for the content or practices of these third parties.

14. Termination

We reserve the right to suspend or terminate your account or access to Pickup at any time, for any reason, including violations of these Terms.

15. Indemnification

You agree to indemnify and hold harmless Pickup, its affiliates, and employees from any claims, damages, losses, or expenses arising from your use of Pickup.

16. Privacy

Your use of Pickup is governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information.

17. Dispute Resolution

a. Governing Law

These Terms are governed by the laws of Hong Kong without regard to its conflict of law principles.

b. Arbitration

Any disputes shall be resolved through binding arbitration in Hong Kong.

c. Class Action Waiver

You waive the right to participate in class action lawsuits or class-wide arbitration.

18. Modifications to the Terms

We may update these Terms at our discretion. Changes will be effective upon posting, and your continued use of Pickup constitutes acceptance of the updated Terms.
